A permanent resident card has an expiration date, but the rules for replacing it reach well beyond that date. Federal regulations list the situations that require a new card, from loss and damage to a legal name change. We explain what the rules say so Louisville residents know when to file.
UnderĀ 8 CFR 264.5, a permanent resident must apply for a new card in several situations. The reasons include a card that was lost, stolen, or destroyed, a card that will expire within six months, and a card that is mutilated. Other reasons include a legal change to the bearerās name or other biographic information and a card that was issued but never received.
The regulation tells a resident to apply when the card will be expiring within six months. That window opens well before the printed date, which leaves room for biometrics, processing, and delivery of the replacement. Form I-90 is the application USCIS provides for this purpose.
OurĀ Louisville resident card renewal lawyer team prepares the filing, gathers the supporting documents, and follows the case after itās submitted. We tell clients to mark the date on a calendar and file as soon as the window opens. Waiting leaves less room for delay.
Loss, theft, destruction, and mutilation each count as grounds to replace the card. A resident who has lost the card should replace it instead of waiting for it to turn up. The prior card must be surrendered for certain reasons, including mutilation and an approaching expiration date, so a damaged card belongs in the file.
OurĀ Louisville green card lawyer team checks the reason for replacement against the regulation so the application cites the right ground. A wrong ground can slow the case. We review it before anything is filed.
A legal name change requires evidence such as a court order or a marriage certificate. Other biographic changes require documents that verify the new information. A card issued with incorrect data because of an agency error is also a ground for replacement, and the original records that show the correct information should be saved.
Filing rules and form editions change over time, so we check the latestĀ immigration policy updates before every filing. That habit protects a client from submitting an outdated version. It takes little time and prevents a rejected application.
The regulation requires a new card when the bearer turns fourteen, unless the card expires before the sixteenth birthday. Parents can miss this rule because nothing about the card looks wrong. The prior card must be surrendered under that rule as well.
Families with several children on different timelines can ask ourĀ Louisville family-based immigration lawyer team to build a calendar of dates. One list of birthdays and expiration dates covers everyone in the household. We keep it current as cards are replaced.
A conditional resident whose card is about to expire doesnāt replace it. The regulation sends that person to the process for removing the conditions on residence. A conditional resident can still seek a replacement for a card that isnāt expiring within ninety days, but only for specific reasons:
Couples in this position can ask ourĀ Louisville marriage green card lawyer team to plan the filing. The deadline for removing conditions is separate from any replacement request. We track both dates.
A resident who plans to apply for citizenship benefits from keeping the card and the dates of residence in order. OurĀ Louisville naturalization lawyer team reviews both together, so a replacement and the later application line up. Clean records make the next filing easier.
