A Form I-9 completed years ago can sit quietly in a personnel file until the day it matters most, usually during a federal inspection or a due diligence review before a sale. Errors that seemed harmless at the time, a missing date, a section completed in the wrong order, tend to surface at the worst possible moment. Louisville employers who have grown through hiring sprees, remote work, or multiple HR staff turnovers are especially likely to be sitting on a mix of correctly and incorrectly completed forms without realizing it.
For employers enrolled in E-Verify, a Louisville business no longer has to sit across a desk from every new hire to complete Section 2. Under a Department of Homeland Security final rule, qualified E-Verify employers in good standing may examine copies of an employee’s documents, conduct a live video interaction to confirm they appear genuine, and retain clear copies rather than physically handling the originals. The option only applies to employers actually enrolled in E-Verify at the hiring site in question, which trips up companies that assume the option applies company-wide.
A handful of steps have to happen in order for the remote process to hold up during an inspection.
Skipping the video step, or forgetting to check the box, is one of the more common mistakes a Louisville I-9 compliance lawyer sees when reviewing files after the fact.
Finding an error on an old form is not, by itself, a violation. How the correction gets made is where employers get into trouble. The accepted method is to draw a single line through the incorrect information, enter the correct information nearby, and initial and date the change. White-out, backdating, or retyping an entire form to hide the original mistake all tend to make a small problem look like an attempt to deceive an investigator, which is a far more serious finding than the original error.
Reviewing every I-9 on file before a government notice arrives gives an employer time to fix what can be fixed and document what cannot. This kind of internal review works best when it follows a consistent method across every file rather than a spot check of whichever forms happen to be easiest to find. Sapon Immigration has walked Louisville employers through this exact process, comparing existing I-9s against current retention requirements and flagging both the remote-verification checkbox issues and the more basic signature and date gaps that show up again and again.
Whether a form was completed in person or through the remote alternative procedure, the underlying retention rule does not change. Employers must keep a completed Form I-9 for three years after the date of hire or one year after employment ends, whichever is later, and must be able to produce it within the short window a federal inspection notice allows. A Louisville I-9 compliance lawyer can confirm whether older files that predate a company’s E-Verify enrollment were handled correctly, since remote verification changes how the document gets examined, not how long the record has to survive afterward.
Cleaning up old files takes real time, but it is far less disruptive than doing it under the pressure of a federal notice with a fixed deadline. Sorting out a compliant remote verification process, correcting existing errors properly, and building a review schedule now keeps this from becoming a recurring scramble later. If your hiring records have grown messier than you would like to admit, reach out and get a second set of eyes on them before someone else does.
