Most employers do not find out their paperwork has gaps until a federal agency comes asking for it. By then, fixing years of missing or incomplete records is far harder than building good habits from the first day of hiring. Two records tend to matter most for companies employing foreign national workers: the Form I-9 file for every employee, and the public access file required for certain sponsored positions, and the two are governed by entirely different sets of rules.
Every employer must complete and retain a Form I-9 for each person hired after November 6, 1986, regardless of citizenship or immigration status. Under 8 U.S.C. Section 1324a, employers are required to verify identity and work authorization for every new hire, and the completed forms must be kept for three years after the date of hire or one year after employment ends, whichever comes later. Errors on these forms are common, and even honest mistakes can turn into fines during an inspection.
A handful of recurring problems tend to appear again and again during Louisville area I-9 reviews.
For employers sponsoring H-1B or similar positions, the Labor Condition Application filed with the Department of Labor comes with its own separate recordkeeping obligation. This public access file must document the wage the employer agreed to pay, the working conditions offered, and related certifications, and it generally has to stay available well beyond the end date of the labor condition application. This is a distinct requirement from the I-9 process, enforced through a different agency, and it is easy for a busy HR department to lose track of one while focused on the other.
When Immigration and Customs Enforcement opens an inspection, the employer is given a notice period to produce its Forms I-9. If reviewers find technical or procedural errors, the employer typically gets a window of at least ten business days to correct them before penalties apply. Substantive violations, or technical errors left uncorrected, can lead to civil fines that scale with the number of affected employees and the severity of the problem, and repeat violations tend to draw a much harder look on any future inspection.
The employers who fare best in an audit are usually the ones who never waited for one to force the issue. A Louisville visa compliance lawyer can run an internal review of existing I-9 and public access files, flag gaps while there is still time to correct them, and set up a process that keeps new hires compliant going forward. Catching a missing signature during a routine review costs far less than explaining it to a federal auditor later.
Even well-run HR departments benefit from an outside review by a Louisville visa compliance lawyer who knows what auditors actually look for. A short audit now can prevent a much longer and more expensive one later.
Sapon Immigration helps Louisville area businesses build compliant hiring practices around Form I-9 and sponsored visa recordkeeping requirements. If your company has not reviewed its files recently, or is preparing to sponsor foreign national employees for the first time, reach out and get ahead of the paperwork before it becomes a problem.
