Congress created two humanitarian visa categories in the same piece of legislation, and people frequently assume they are interchangeable. They are not. The T visa exists specifically for victims of severe forms of trafficking, whether sex trafficking or labor trafficking, while the more commonly discussed U visa covers a broader range of qualifying crimes including domestic violence and assault. Confusing the two can lead someone to apply under the wrong category entirely, wasting months before the mistake gets caught.
Eligibility requires being a victim of trafficking involving force, fraud, or coercion, or trafficking of a minor into commercial sex, along with physical presence in the United States as a direct result of that trafficking. A Louisville T visa lawyer will typically start by establishing this connection clearly, since USCIS looks closely at whether the applicant’s presence in the country truly stems from the trafficking itself rather than an unrelated later decision to stay after arriving for some other reason.
Unlike the U visa, a T visa applicant generally must comply with reasonable requests from law enforcement to assist in investigating or prosecuting the trafficking, though there is no requirement for a formal certification signed by an agency the way a U visa petition needs one. Certain applicants, including those under 18 at the time of the trafficking or those who suffered trauma that would make cooperation unreasonable, can qualify for an exception to this requirement entirely.
A T visa petition, filed on Form I-914, generally needs to establish several distinct elements at once, and gaps in any one of them can slow the case down considerably.
Evidence that severe trafficking occurred, through personal statements, police reports, or other corroboration
Proof of physical presence in the United States connected to the trafficking
Documentation of cooperation with law enforcement, or a valid exception to that requirement
Evidence that removal from the United States would cause extreme hardship involving unusual and severe harm
Congress limits T visas to 5,000 principal applicants per year, but unlike the U visa cap, this limit has rarely been reached. That means most eligible applicants do not face the years-long waiting list that has become routine for U visa petitioners, which makes the T visa category meaningfully faster for people who qualify. Sapon Immigration makes sure trafficking survivors and their families understand this practical difference early, since it can change how a case gets prioritized alongside other options.
A T visa is generally valid for four years, and a holder can apply for permanent residence after three years, or sooner in certain law enforcement cooperation scenarios, provided they meet continuous physical presence and other requirements at that point. This built-in path toward a green card is a meaningful advantage over some other humanitarian categories that leave status less certain over the long term, since a survivor can plan toward permanence from the day the T visa is approved rather than waiting to see what comes next.
Depending on the survivor’s age at the time of the trafficking, certain family members, including a spouse, children, and in some cases parents or siblings, may qualify to be included in the petition as derivatives. A Louisville T visa lawyer can identify which relatives qualify early, since some family members located abroad need additional processing steps before they can join the survivor in the United States.
Coming forward after trafficking is difficult enough without also facing an unfamiliar immigration process alone. If you or someone you know has survived trafficking and is trying to understand what legal protection might be available, reach out so we can talk through the situation carefully and confidentially.
